    procedure MOB RO ADS SRL processes orders placed via the online sales system www.Leggance.ro.

MOB RO ADS SRL shall not be held liable for the consequences of an order being placed incorrectly or illegibly by the Customer, in particular for inaccuracies that result in a delay in fulfilling the order or the non-delivery of the products ordered.

Placing an order does not bind MOB RO ADS SRL, but the absence of a response does not constitute tacit acceptance of the order.

After placing the order, the Customer will receive confirmation of the order placed at the email address indicated in the order.

The sales contract comes into effect upon issuance of the invoice by MOB RO ADS SRL for the products ordered by the customer, to the address specified in the order. Notification of the invoice’s issuance is provided by telephone or electronically (email). The general terms and conditions of sale shall form the basis of the contract thus concluded.

To purchase and take possession of the products offered for sale on Leggance.ro, you must complete the following steps:
- identifying and selecting the products
- registering as a user of Leggance.ro
- making payment for the products. Payment is made online or by bank transfer/payment order, under the conditions set out in Chapter VII, and the final cost will include the price of the ordered product (including VAT), the delivery charge and, where applicable, the cost of the green stamp, in accordance with the provisions of Government Decision 448/2005.
- Delivery of the ordered and paid-for products will be accompanied, where applicable, by the warranty certificate, the certificate regarding the after-sales service provided by the manufacturer/importer/distributor and/or other certificates where applicable.

VII. How to Buy
VII.1. Prices
Unless otherwise stated, the product prices displayed on Leggance.ro are the final purchase prices and include VAT (19% value added tax, applicable in Romania). Prices never include delivery costs. Final purchase prices may be prices suggested by manufacturers or suppliers, or may be estimated based on standard prices applicable within the industry for the product being sold. Final purchase prices may not represent the most competitive prices in a particular product segment or for a specific period.
Ownership of the products will be transferred to the Customer upon full payment of the price for the respective products following confirmation of order processing.

INCORRECT PRICE OR FEATURES. MOB RO ADS SRL makes every effort to provide accurate information regarding the price, stock and features of the products. It is possible that some prices and/or features may be incorrect. In the event of an order being placed at an incorrect price, MOB RO ADS SRL reserves the right to cancel the Customer’s order. In the event of an order being placed for a product with incorrect specifications, MOB RO ADS SRL will make every effort to deliver to the Customer a product with specifications as close as possible to those presented on the website at the time the order was placed. If the Customer does not agree with MOB RO ADS SRL’s proposals, the Customer has the right to cancel the order.

 

VII.2. Payment
methods To pay for the products ordered, you may choose from the following payment methods: secure online payment or cash on delivery. If you have chosen to pay cash on delivery, after placing your order you will receive the relevant order details by email in the form of an invoice, and you will then pay for the product to the delivery person.

VII.2.1. How to buy and pay for products on the Leggance.ro website You can buy products via Leggance.ro by following 3 steps:
a. Select the product you wish to purchase and click on the "Order now" link.
b. Enter/confirm your personal details.
This information is necessary for the correct and efficient processing of your order. Please complete the form correctly and specify the persons to whom the invoice and delivery are to be addressed. The email address is of the utmost importance as information regarding the order and the products ordered will be sent via email. An incorrect email address slows down the entire ordering process. Furthermore, the Company will not be able to contact you and inform you of the status of your order. If the delivery address is not the same as the billing address, please indicate this by unchecking the option. The delivery address is the same as the billing address at the end of the form. Select your preferred payment method and confirm the details by selecting "Next step". If the delivery address, or the billing address, or both addresses are not the same as the addresses you have registered in your user account on the Website, before proceeding to the next step in the ordering process, please enter the valid billing and/or delivery addresses for that order.

VIII.1.1 Delivery of products

Shipping costs are borne by the Customer, unless otherwise agreed in a separate contract between the Customer and MOB RO ADS SRL

The amount of the shipping costs depends on the weight of the parcel, its dimensions, the destination, the chosen carrier/forwarder and the payment method.

If the weight of the parcel exceeds the limit for the relevant destination (or if no such limit has been set), the shipping costs will be determined by the Sales Department of MOB RO ADS SRL

Most of the products displayed on the website www.Leggance.ro are available either from the supplier’s stock or in the shop’s physical stock. MOB RO ADS SRL does not guarantee that all products displayed on the website are in stock. For products not in stock at MOB RO ADS SRL, the delivery time is displayed on the website or will be communicated to the Customer by telephone or email. Delivery times are indicative, unless the Customer has agreed a delivery time with MOB RO ADS SRL under a separate contract.

MOB RO ADS SRL decides on the choice of carrier/courier, unless otherwise agreed in individual contracts between the Customer and MOB RO ADS SRL.

It is possible to collect the products from the MOB RO ADS SRL premises. The Customer may pay in cash or by card at the MOB RO ADS SRL premises.

VIII.1.1.0 Voucher – Terms and Conditions – The
voucher is non-transferable and may only be used by the person who received it.
-The voucher is valid for a single order and cannot be combined with other promotional codes or active offers
.-In the event of a return for an order in which a voucher was used:-The value
of the voucher will not be refunded in cash
.-The voucher can be reactivated only once
.-After reactivation, the voucher must be used in a new order.
-A maximum of one return per voucher is permitted, to prevent misuse (repeated orders and returns based on the same voucher).
-The voucher cannot be exchanged for cash and cannot be used to purchase other vouchers
.-The voucher is valid only for the eligible products listed alongside the voucher.
-If the order value is less than the voucher value, the difference will not be refunded
.-LEGGANCE reserves the right to cancel orders or deactivate the voucher in the event of suspected misuse or fraud
.-The voucher has a limited validity period, specified at the time of issue.

VIII.1.2 Cancellation of an Order

LEGGANCE reserves the right to cancel any order placed, regardless of whether it was paid for by cash on delivery or online (in which case the amount paid will be refunded in full), in any of the following situations:

1. Failure to confirm the order

The order may be cancelled if the customer is contacted by email or telephone for confirmation and does not respond within a reasonable time.

2. Incorrect or incomplete details

The order may be cancelled if the information provided for delivery and/or billing is incorrect, incomplete, or cannot be verified, and the customer does not provide the additional details requested by LEGGANCE operators.

3. Inappropriate behaviour

LEGGANCE reserves the right to cancel the order and suspend commercial interaction where the customer uses abusive or offensive language, makes unfounded accusations, or displays inappropriate behaviour.

4. Product out of stock

If the ordered product is no longer available and there is no possibility of restocking within a reasonable timeframe, the order may be cancelled and the customer will be informed immediately.

5. Suspicions of fraud or misuse

Orders may be cancelled if there are reasonable grounds to suspect fraud, misuse of data, attempts to circumvent commercial procedures, or any other actions that may affect the operational integrity of the shop.

6. Inability to deliver due to external reasons

The order may be cancelled if delivery cannot be made for reasons beyond LEGGANCE’s control (inaccessible address, refusal to accept the parcel, courier logistics issues, etc.).

7. Repeated uncompleted orders

LEGGANCE may refuse future orders and cancel current orders if there is a history of unconfirmed orders, orders refused on delivery, or orders cancelled for reasons attributable to the customer.

8. Technical or system errors

In rare instances where an order is generated as a result of a technical error (incorrect price displayed, incorrect stock levels, platform issues), LEGGANCE reserves the right to cancel the order and inform the customer. Amounts paid online will be refunded in full.

 

  1. Warranty and after-sales
    service All products sold via the website www.Leggance.ro are covered by warranty terms in accordance with current legislation and the manufacturers’ commercial policies. The products are new, in their original packaging, and sourced from suppliers authorised by each individual manufacturer.
    If a product comes with a warranty, its terms are binding.

  2. Product
    descriptions and returns Leggance.ro makes every effort to be as accurate as possible. However, Leggance.ro does not guarantee that product descriptions or other related materials are accurate, complete, up to date or free from errors. If a product offered by Leggance.ro differs from its description on the Website, you may return it in accordance with the Website’s Product Return Policy and in compliance with current Romanian legislation.

The consumer has the right to notify the trader in writing that they are cancelling the purchase, without giving any reason, within 14 working days of receiving the product or, in the case of the provision of services, from the conclusion of the contract, in accordance with the provisions of Ordinance No. 130/2000.

 

Should you wish to exercise this right, you have the following obligations
:- to return the purchased product in its original, undamaged packaging, at your own expense
; - to return the purchased product in working order, undamaged, in the condition in which it was delivered to you, including the bag and the product labels.

The costs of both outward and return delivery remain the customer’s responsibility and are borne by the customer.

  1. Limitation of
    Liability MOB RO ADS SRL is not liable for damages arising from failure to meet the delivery deadline, the delivery of products with specifications differing from those in the online offer, failure to deliver a product, or price changes. In particular, we are not liable for production stoppages, loss of profit or indirect losses arising from the failure to deliver the relevant product by a specified deadline. The above limitations do not apply to situations where a separate contract has been concluded between MOB RO ADS SRL and the Customer for the delivery of a specific product, in which the delivery terms and liability for non-compliance with them have been specified.

MOB RO ADS SRL shall not be liable for the consequences of using the delivered products in a manner inconsistent with their intended purpose.

MOB RO ADS SRL is not liable for any unlawful use of products purchased from MOB RO ADS SRL.

Once you have received the products from us, please check immediately that their characteristics do not deviate from your requirements.

MOB RO ADS SRL and its suppliers accept no liability for printing or display errors regarding prices, specifications, images shown, etc. In the event that the price of the product or some of its specifications have been incorrectly entered into our databases or displayed incorrectly, and delivery has not yet taken place, MOB RO ADS SRL reserves the right to cancel the delivery of the product in question and to notify the customer as soon as possible of the error.

Furthermore, the images are presented on the website for illustrative purposes only, and the products delivered may differ in any way due to changes in specifications or design, without prior notice from manufacturers and/or suppliers.

The maximum liability of MOB RO ADS SRL towards any customer, in the event of an incorrect delivery, is the amount collected from that customer.

MOB RO ADS SRL shall not be liable for any damages, costs, legal proceedings, claims or expenses arising from users’ failure to comply with the “terms of cooperation”.

MOB RO ADS S.R.L. shall not be liable for any losses arising from the website’s malfunction or from the inability to access certain links published on the website.

 

XII. Reviews, comments, communications and other types of content
Users may post reviews, comments or other types of content; send suggestions, ideas, ask questions, propose articles or other types of material, provided that such content is not illegal, obscene, threatening, defamatory, does not infringe upon the right to privacy or the law regarding the protection of intellectual property; does not contain computer viruses, commercial or political communications, or content that incites hatred or intolerance on grounds of ethnicity, religion, race or sexual orientation, mass messages or other forms of spam. When posting reviews, comments, messages and other types of content, you may not use false email addresses or identities. Leggance.ro reserves the right, but is under no obligation, to remove or edit all types of content posted by users and is under no obligation to review this content periodically. By posting reviews, comments, messages and other types of content on Leggance.ro, you transfer, unless the Company indicates otherwise, the intellectual property rights, on a non-exclusive, perpetual and irrevocable basis, to the materials posted. The Company has the right to modify, reproduce, transmit, adapt, publish and distribute the materials posted by users via any means of mass communication, from any country. By posting reviews, comments, messages and other types of content on leggance.ro, you grant the Company the right to use your name in connection with the posted materials; you warrant that you own or otherwise control the intellectual property rights to the materials you post; that the posted materials do not breach any of the terms and conditions for posting reviews, comments, messages and other forms of user-generated content on leggance.ro.
Leggance.ro has the right, but not the obligation, to monitor, edit or delete any type of content or user activity on the Site. Leggance.ro is not responsible and accepts no liability for any of the materials posted by third parties on the Site. Leggance.ro has the right not to publish all comments and articles submitted by users.

XII. Force Majeure
Leggance.ro, its affiliates and/or, in general, suppliers of products or services to Leggance.ro cannot be held liable for any delay or error resulting directly or indirectly from causes beyond Leggance.ro’s control. This exemption includes, but is not limited to: malfunctions of the technical equipment at Leggance.ro, failure of the internet connection, failure of telephone connections, computer viruses, unauthorised access to Leggance.ro’s systems, operational errors, as well as cases of force majeure as stipulated by the Romanian legislation in force.

XIII. Advertising
Leggance.ro may display, on its pages, advertisements for products in its range as well as for products or services belonging to third parties. By using Leggance.ro and by accepting its Terms and Conditions of Use and Privacy Policy, you expressly consent to receiving such commercial communications.

XIV. Complaints regarding breaches of intellectual
property law Leggance.ro respects the intellectual property rights of third parties. If you have noticed that the Website contains information that infringes their intellectual property rights, please send us a notification to the email address: reclamatii[at]c-shop.ro, or contact us via the fax and telephone numbers, or at the postal address, displayed in the ‘About Us’ section of this contract.

    legislation The services provided by the Company via Leggance.ro are governed by the provisions of Romanian law, in particular Law 365/2002 on electronic commerce, Ordinance 130/2000 on consumer protection in the conclusion and performance of distance contracts, Government Decision 448/2005 and European Directive EC/96/2002, which regulates the green stamp duty regime applicable to electronic products.
    The terms and conditions of Leggance.ro are subject to Romanian law. In the event of a dispute, an attempt will first be made to reach an amicable resolution within 30 working days of the complaint being registered at the offices of MOB RO ADS SRL. If no agreement can be reached within the aforementioned timeframe, disputes between the Parties shall be referred to the competent courts within the jurisdiction of Bucharest.

XVI. Presentation of the Offer
MOB RO ADS SRL reserves the right to make changes at any time to the prices and technical specifications on the Leggance.ro website, without prior notice.
